Homes in Focus 386 Real Estate Photography LLC

1. Service Agreement
By booking services with Homes in Focus 386 Real Estate Photography LLC (“the Photographer”), you agree to the following Terms of Service for all digital imagery, video, and property marketing products.
All services must be booked through the order form located on the website.
The Photographer retains full copyright ownership of all media.
A limited commercial usage license is granted upon full payment (see Section 7: Media Usage).
2. Cancellation & Rescheduling
When a session is booked, that time slot becomes unavailable to other clients.
If the property will not be ready or needs to be rescheduled, please contact:

Cancellation Fees
Tuesday–Friday Appointments:
• Cancel/reschedule after 5:00 PM the day before → $50 fee
• Fee waived if the appointment is filled by another client
• Twilight shoots excluded
Monday Appointments:
• Cancel/reschedule after 4:00 PM on the Saturday prior → $50 fee
• Fee waived if replaced
• Twilight shoots excluded
Unable to Shoot Fee
If the Photographer arrives and the property is:
• inaccessible,
• unsafe, or
• not in shoot-ready condition,
the following applies:
• $75 daytime appointment
• $100 twilight appointment
• plus any applicable travel charges
Once photography begins, the session cannot be canceled, and the full fee is due.
3. Weather Policy
If weather conditions may impact the shoot, the client may choose to continue or reschedule.
If the session continues under poor weather conditions:
• Exterior photos may be postponed at the Photographer’s discretion
• A return trip for exterior photos will be quoted based on travel distance and time required
4. Payment Policy
Payment is due within 48 hours of project delivery unless otherwise arranged.
Accepted payments: Cash, Check, or Credit/Debit Card.
Returned checks will incur an additional fee.
Payment is required regardless of listing status, sale of the home, or external conditions.
5. Property Preparation & On-Site Conditions
The property must be clean, staged, and photo-ready at the scheduled appointment time.
The Photographer:
• Does not clean, dust, or move furniture
• May adjust blinds, curtains, or lights
• May move small distracting items (trash cans, tissue boxes, soap bottles, cords, etc.)
• Will not digitally remove or disguise permanent features or property defects
Client responsibilities:
• Ensure all areas to be photographed are accessible
• Secure pets (Photographer is not responsible for pets escaping)
• Supervise children and keep them out of camera view
• Ensure the property is safe for photography
6. Delivery
• Still photos are delivered by within 24-48 hours.
• Video, floor plans, drone, and additional products may require longer processing times.
7. Media Usage — Limited Commercial License
All media remains the sole copyright of the Photographer.
Upon full payment, the client receives a non-exclusive, limited commercial license allowing use of the images for:
Permitted Use (CAN):
✔ Marketing the specific property for up to 2 years, or for the duration of the active REALTOR® listing (whichever is longer)
✔ MLS, real estate websites, brokerage sites
✔ Print materials, brochures, flyers, and social media
✔ Use by the hiring agent and their brokerage
Not Permitted (CANNOT):
✘ Transfer images to another agent, homeowner, builder, or business
✘ Use images to market a different property or service
✘ Sell, sublicense, or otherwise redistribute the images
✘ Heavily alter, manipulate, or distort the images
✘ Create artwork, prints, or products for commercial sale
✘ Continue use after listing changes agents unless a license transfer fee is paid
License Transfer Fees
A license reissue fee may apply when:
• A new agent takes over the listing
• A new brokerage inherits the listing
• A homeowner wants images separate from the listing
• A builder, contractor, or vendor wants to use images for marketing
8. Copyright & Portfolio Use
The Photographer retains all copyrights to all media (U.S. Copyright Law, Title 17).
Homes in Focus 386 Real Estate Photography LLC may use the media for:
• portfolio and website
• advertising and print materials
• social media and digital showcases
• professional competitions or displays
Clients may request exclusion from portfolio use in writing before the shoot.
9. Acceptance of Terms
By booking any service, you acknowledge that you have read, understand, and agree to these Terms of Service.
